4) Assumption of Risk I voluntarily assume all risks of injury, death, and property damage arising from or related to the test ride, whether caused by my actions, the actions of others, road conditions, equipment condition, or otherwise.
5) Release and Waiver of Liability In consideration for being allowed to test ride an e-bike, I hereby release, waive, and discharge Summit City Ebikes LLC, its owners, employees, contractors, volunteers, and affiliates (“Released Parties”) from any and all claims or causes of action for injury, death, property damage, or other loss arising out of or related to the test ride, including claims based on the negligence of the Released Parties, to the fullest extent permitted by law.
6) Indemnification I agree to indemnify and hold harmless the Released Parties from any claims, demands, liabilities, damages, costs, or attorney fees arising from:
my participation in the test ride,
my misuse of the e-bike,
my violation of laws or instructions, or claims made by third parties due to my actions.
7) Responsibility for Damage/Loss I agree to return the e-bike and any accessories in the same condition as received, normal wear excepted. I understand I may be responsible for damage, loss, theft, or misuse during the test ride, including damage caused by my negligence or reckless riding.
8) Medical Consent If I am injured, I authorize Summit City Ebikes LLC to obtain or request emergency medical treatment for me if needed. I understand I am responsible for all medical costs.
9) Severability If any part of this agreement is found invalid or unenforceable, the remaining portions shall remain in full force and effect.
10) Entire Agreement I understand this document is the entire agreement regarding the test ride and that no oral statements change its terms.
